The USPTO reports PTAB trial activity by fiscal year, which runs from October 1 to September 30. A report dated November 13, 2014 counts filings and decisions in fiscal year 2015 up to that date, alongside cumulative totals since AIA trials began on September 16, 2012.

What PTAB trial statistics measure

  • Petitions filed, split by proceeding type (inter partes review, post-grant review and, until September 16, 2020, covered business method review) and by technology area.
  • Institution decisions: how many petitions led to a trial and how many were denied.
  • Outcomes: final written decisions, settlements and other terminations.
