PTAB Oral Hearing Orders
An oral hearing order sets the time, format and rules for argument in an AIA trial. These notes explain what such orders cover, including demonstrative exhibits and time allocation.
Oral argument is the last stage before a final written decision. The hearing order allocates time, sets deadlines for exchanging demonstratives, and reminds parties that demonstratives are not evidence and cannot introduce new arguments.
Designations and rules change. Before relying on any decision, confirm its current status on the USPTO PTAB pages.
