Precedential PTAB Decisions
A precedential decision binds later panels of the Patent Trial and Appeal Board unless it is overruled or de-designated. These notes cover decisions grouped as precedential; designations change, so check the USPTO's current list before relying on one.
The Board designates a small number of decisions as precedential under its standard operating procedures. A precedential decision binds later panels in similar cases, which makes it the closest thing to case law inside the PTAB. Several decisions listed here were later superseded by Federal Circuit or Supreme Court rulings, or de-designated; each note explains its later history where it is known.
Designations and rules change. Before relying on any decision, confirm its current status on the USPTO PTAB pages.
